WhatsApp group admin not liable for objectionable post by other member: High Court

An administrator of a WhatsApp group can't be held criminally responsible for an objectionable post by another member of the group, the Nagpur bench of the Bombay supreme court has held and quashed a case of harassment lodged against a 33-year-old man. The order was passed last month and a replica of it had been made available on April 22. A division bench headed by Justice Z A Haq and A B Borkar noted that an administrator of a WhatsApp group has only limited powers of adding or deleting members to the group and doesn't have the facility to manage or censor the content posted within the group. The court passed its order on an application filed by Kishor Tarone (33), the administrator of a WhatsApp group. In an effort to ramp up India's immunization campaign, more than 20 states, so far, have announced that they will provide free   Covid-19 vaccines   to their people. While some have made the coronavirus vaccine free for all, others have said that it will be free for people between the age of 18 to 45 only. Many states, including Delhi, Maharashtra, Karnataka, Haryana, Odisha, Jharkhand and West Bengal and others, have decided to provide free vaccines to the people in their respective states. Till now, more than 14.19 crore Covid-19 vaccine doses have been administered in the country to people above the age of 45, and health care and frontline workers, as part of the world's largest vaccination drive, which completed 100 days on 25 April. The Election Commission is singularly responsible for the second wave of Covid and should probably be booked for murder, the Madras High Court observed today in the sharpest criticism yet of crowded campaigns for the five state polls that continued in the middle of raging virus cases. The court has threatened to stop the counting of votes on Sunday if a "blueprint" is not in place. The Election Commission will react after it sees the order, sources say. "Your institution is singularly responsible for the second wave of COVID-19. Your officers should be booked on murder charges probably," the Madras High Court told the Election Commission. The election body had failed to enforce Covid safety rules like masks, sanitisers and distancing during campaigning despite court orders, said the High Court. Karnataka has announced a two-week lockdown from tomorrow, a day after reporting the biggest rise of over 34,000 new cases in 24 hours. "COVID curfew will be implemented in the state from tomorrow 9 pm for the next 14 days," Karnataka Chief Minister BS Yediyurappa said, using the phrase "close down". Essential services will be allowed between 6 am and 10 am and shops will close after that. There will be no public transport during the curfew, the Chief Minister said. Only construction, manufacturing and agriculture sectors are allowed to work. Travel within the state and to other states will also not be allowed, except for emergencies. "People will have to cooperate. If they do, we can achieve our target," Mr Yediyurappa said. The Chief Minister said government hospitals would provide free vaccinations for those between 18 and 44 years; the Centre has announced that those over 45 will be given shots free of cost.
